I wrote K&L and asked where the rub was and here
is the response:
Thanks very much for taking the time to respond.
The bill was amended on Monday, to change the language that threatened our right to ship wine to California consumers, thanks in part to the
efforts of people like you to shed light on the language in the bill.
The problem that was fixed was in section (g), where it made it a crime for any person to ship wine without a permit, and did not allow
retailers to apply for such a permit.

And here is the amended section:
(g) Sales and shipments of wine direct to consumers in California from (persons "PERSONS" WAS DELETED AND REPLACED WITH "WINEGROWERS") winegrowers who do not possess a current wine direct shipper permit from the department are prohibited. Any person who knowingly makes, participates in, transports, imports, or receives such a shipment is guilty of a misdemeanor pursuant to Section 25617.

SB 118 as amended 6/27/05
Interesting that they invented a new crime for winegrowers to commit in this process.
